1.4 By placing an order, you agree to be bound by these Terms and Conditions.
2. Definitions
2.1 Consumer: An individual acting wholly or mainly outside their trade, business, craft, or profession.
2.2 Goods: Items supplied by Smithers UK Limited as set out in your Order.
2.3 Order: Your request to purchase Goods via our website.
2.4 Contract: The legally binding agreement formed when we confirm your Order by email.
3. Basis of Sale
3.1 All descriptions, images, and specifications on the website are indicative.
3.2 A Contract is formed only when you receive an Order Confirmation email from us.
3.3 You are responsible for ensuring all Order details are correct before placing your Order.
3.4 Goods may be produced in small batches or individually and are not mass-produced unless stated.
4. Prices & Payment
4.1 Prices are as stated on the website at the time of order.
4.2 Full payment is required before Goods are dispatched or production begins.
4.3 We reserve the right to refuse or cancel orders where payment cannot be verified.
5. Delivery & Risk
5.1 Delivery dates are estimates only.
5.2 Risk passes to the Customer upon delivery.
5.3 Goods must be inspected on delivery. Any transit damage must be reported within 48 hours.
5.4 Failure to retain original packaging may affect insurance claims.
6. Conformity of Goods
6.1 We have a legal duty to supply Goods that conform to the Contract.
6.2 Upon delivery, Goods must:

be of satisfactory quality,

be reasonably fit for any purpose made known to us before the Contract,

conform to their description.
7. Faults, Snagging & Remedies
7.1 Where Goods develop a fault or snag, we are entitled to a reasonable opportunity to repair or rectify the issue first.
7.2 Rectification may include adjustment, repair, finishing work, or replacement of components.
7.3 Dissatisfaction alone does not constitute non-conformity.
7.4 Refunds or exchanges will only be considered where rectification is impossible or has failed after reasonable attempts.
8. Warranty
8.1 Bespoke furniture carries a 12-month warranty from delivery for manufacturing defects.
8.2 Wear and tear, misuse, environmental damage, or commercial misuse are excluded.
8.3 Where a fault arises within the first 3 months, rectification will be offered in the first instance.
9. Commercial & Contract Furniture
9.1 Contract or commercial-grade furniture is supplied only where expressly stated in writing.
9.2 Where no contract, Crib 5, or commercial specification is agreed, Goods are supplied as domestic-standard bespoke furniture.
10. Limitation of Liability
10.1 Nothing in these Terms limits liability for death or personal injury caused by negligence.
10.2 We are not liable for indirect or consequential losses.
10.3 Liability is limited to the value of the Goods supplied.
11. Governing Law
11.1 These Terms are governed by the laws of England and Wales.
11.2 Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
12. Cancellation, Returns & Bespoke Goods
12.1 Off-the-Shelf (Non-Bespoke) Goods
12.1.1 Consumers may cancel non-bespoke Goods within 14 days of delivery.
12.1.2 Goods must be unused, in original packaging, and in resaleable condition.
12.1.3 Return shipping costs are the responsibility of the Customer unless Goods are faulty.
12.2 Bespoke & Made-to-Order Goods
12.2.1 Bespoke and custom-made Goods are non-cancellable and non-refundable.
12.2.2 This includes (but is not limited to) furniture made to order, commissioned items, custom finishes, sizes, or specifications.
12.2.3 The statutory 14-day cooling-off period does not apply to bespoke or made-to-order Goods.
12.2.4 Refunds for bespoke Goods will only be considered if rectification is impossible or has failed after reasonable attempts.
